Another 385 files are being processed

Dear Residents,

I was informed that another 385 files are now being processed. The batch of 400 files have been registered and by now, most of the residents should be receiving your letters. We strongly urge you to immediately collect your final title as soon as you receive the letter from the Land Office. This will facilitate the work of the Taman Kepong Action Group.

The reasons we are saying this:

(a) There are a number of files still registered under the name of the developer. We plan to work closely with the Land Office to identify the ownership of the land -- whether it is the open space that has not been gazetted as green lungs, or they are land owned by the developer but sold to individual purchasers but both developer and purchasers failed to carry out the transfer of property. If this being the case, the Land Office will assist the purchasers to carry the transfer with minimum charges except the stamp duty payable.

(b) After 80% of the residents have received their final titles, it will be much easier for the committee to look into the 20% whose files are still pending. Some of the owners have put the old correspondence address; hence, letters sent out by the Land Office might have gone to the old home. For owners who have not received the letter yet, you can either contact Land Office and provide them with the HSD and PT Number to see if your title has been issued; or you can check with the tenants of the old house to see if the letter had been sent to them.

(c) According to JUPEM, some 50 files are being held up in JUPEM for various reasons. It is learnt that the rest of the files have already been submitted to the Technical Department at the Land Office since two years ago. The Action Group is planning to meet with the Head of the Technical Department to see how these files can be processed and expedited so that residents of Taman Kepong can obtain their final titles soon.

At this juncture, the Committee would like to register a word of appreciation to the certain staff of the Land Office as well as to YB Dr Tan Seng Giaw for assisting residents to obtain the final titles.

There will be another meeting at Pemadam Office on 13 March 2011 (Sunday) 3:00pm. Please be there. Those who have obtained your final title, please bring along a copy of the title.

Titles still in the name of Kepong Garden Development Sdn Bhd

Dear Friends,

It is learnt that a number of you are still having titles (currently, Hakmilik Sementara) which are registered under the name of the developer, Kepong Garden Development Sdn Bhd.

Although this company is now defunct, it is best to get these things sorted out before things get more complicated for the next generation, who may not be keeping the documents necessary for them to carry out a proper subdivision.

Please contact Mr Arumugam (muarum@gmail.com) or myself (ejng@pc.jaring.my) if you are encountering this problem. We hope that the Land Office will take this issue seriously and resolve it once and for all.

If you have purchased the house from another owner, please make sure that the name has been changed. Although you are the rightful owner, you have to ensure that the documents are in place.

More than just Taman Kepong

Dear Friends,

The Chairman of Taman Kepong Action Group, Mr Aru and I went to see a resident in Kepong Baru, whose address is on the list given by the Land and Mines Office recently.

To our surprise, it's not only Taman Kepong, but the entire of Kepong Baru apparently faces the same issue.

It looks like we have to get the house in order so that the FT Land and Mines Office will from now put their focus on issuing the final title. We sympathise with the existing batch of staff working there, because the issuance of final title has been neglected by previous batches of staff at the Land and Mines Office.

We hope that more staff will be deployed to expedite the issuance of the final title to all residents within the Federal Territory. While we need to give time to the Land Office, they have to fulfill their one-month deadline.

Penjelasan dari pihak Pejabat Tanah berkenaan dengan Hakmilik Sementara

Tuan,

Saya ingin menjelaskan sedikit mengenai maksud Hakmilik Sementara (Qualified Title) atau QT yang dikeluarkan oleh Pejabat Tanah atau Pejabat Pendaftar. Istilah Hakmilik Sementara tersebut bukan membawa maksud pemberimilikan tanah itu kepada seseorang diberi secara sementara sahaja. Yang beri maksud sementara ialah geran (title) sahaja (bukan pemilikan tanah) kerana status pegangan ke atas tanah berimilik bagi kedua-dua jenis hakmilik QT dan FT merupakan hakmilik yang tidak disangkal (Indefeasible title) mengikut Seksyen 340 Kanun Tanah Negara. Pengeluaran QT dibuat kerana keluasan tapak tanah belum dapat dimuktamadkan. Setelah keluasan tanah diukur halus dan dimuktamadkan melalui pelah PA, barulah pengeluaran Hakmilik FT dibuat. Ini berlainan daripada tanah TOL (Temporary Of Licence – tanah pendudukan sementara).

Response from FT Land Office & Good News to Taman Kepong residents

Selamat Tahun Baru Cina.

Email tuan di bawah dirujuk. Untuk makluman tuan, Bahagian Teknikal jabatan ini telah selesai membuat semakan terhadap 436 pelan FT bagi Taman Kepong di mana kesemua Hakmilik tersebut sedang giat didaftarkan. Proses pendaftaran dijangka selesai dalam tempoh 1 minggu dan selepas itu akan disusuli dengan notis kepada pemilik supaya menukar Hakmilik QT yang dipegang oleh mereka kepada Hakmilik FT.

2. Jabatan ini masih menunggu baki pelan FT dan PA bagi hakmilik fasa 2 daripada JUPEM. Saya tidak dapat menjangkakan berapa lama lagi kerana ianya berada di luar kawalan jabatan ini.

3. Saya memohon kerjasama pihak tuan agar perkara ini tidak terlalu didesak supaya proses pengeluaran Hakmilik FT dapat disempurnakan tanpa berlaku kesilapan. Apa yang ingin ditegaskan ialah pengeluaran FT akan dibuat bagi semua Hakmilik terlibat kerana perkara tersebut merupakan tanggungjawab jabatan ini.

Memandangkan penukaran hakmilik QT kepada FT diterima serentak dalam jumlah yang besar maka proses pengeluaran FT telah mengambil masa yang lebih lama. Dipohon pihak tuan banyak bersabar. Sekian, terima kasih.
