KUALA LUMPUR: There's light at the end of the tunnel for Taman Kepong residents, almost four months after the qualified title issue was raised.

Residents' Action Group chairman M.U. Arumugam said by the end of this month, most house owners should be receiving a letter of notification from the Federal Territory Land and Mines Office to collect their final title.

To date, 475 titles in Phase One of Taman Kepong have been registered and are ready for collection, while 49 are still pending.


In Phase Two, 385 of 600 titles have been registered.

The remainder will be registered by month-end.

"We were told all 1,124 qualified titles should be converted into final titles soon," he said.


However, Arumugam said there are a number of other issues which cropped up.

"It was harder to trace some transactions as residents did not keep proper records and the Taman Kepong title issue is four decades old.

"Some have lost their sales and purchase agreements and memorandum of transfer. Evidence of this nature is important in order to prove ownership of the land."


This is one reason the Action Group urged residents to immediately collect their titles the moment they are registered.

Arumugam said there are many titles that are issued in the name of the developer, Kepong Garden Development Sdn Bhd, which means, the transfer has not been properly executed.

"These owners will not receive their title deeds, until the memorandum of transfer is properly executed with the consent of the developer."

Arumugam said according to the land office, the developer still exists as a company with a registered address in Cangkat Raja Chulan, Kuala Lumpur.

"The land office is willing to assist with the transfer but the owners will have to fork out the stamp duty. Without a proper transfer being carried out, the ownership of the property could be disputed and we do not wish for this to happen."

Stephen Ng, a resident, said his mother was given photocopies of the title in 1994.

"We discovered that it was a photocopy of the qualified title and no transactions were made," he said.

Ng urged all house buyers to check their documents to make sure that they are in order.

There are also titles that still carry the old correspondence addresses.

"Letters from the land office do not reach homeowners. The onus is on house owners to update the department of their new addresses."

Kepong MP Dr Tan Seng Giaw said he will also be looking into a similar issue involving residents of Kepong Baru and Jinjang.

"Land matters are important to the people, and should be dealt with urgently," he said.

Dr Tan said a number of other housing estates throughout the country are facing similar issues and there are loopholes which allow developers to abscond from its responsibility.

"I will raise this matter in parliament soon, to urge the Government to come up with a more effective mechanism to monitor developers to ensure that they are fulfilling their obligations," he said.

Timbalan Pengerusi Kebangsaan DAP dan Ahli Parlimen Kepong Dr Tan Seng Giaw mendesak Kerajaan Pusat supaya mempertimbangkan dengan sedalam-dalamnya terhadap projek membina dua reaktor nuklear di negara ini.

Letupan dan kebocoran reaktor nuklear di Jepun selepas dilanda gempa bumi skala Richter 9 dan tsunami memberi gambaran yang buruk kepada dunia.

Pada 15.3.2011, Dr Tan mengulas kenyataan Timbalan Perdana Menteri YAB Tan Sri Muhyiddin Yassin untuk meneruskan projek tersebut. Malaysia Nuclear Power Corporation dikatakan telah memanggil tender untuk konsultan-konsultan luar negara untuk mengkaji tempat dan keadaan yang sesuai bagi mengadakan dua reaktor.

Walaupun Malaysia adalah terlindung daripada gempa bumi, tsunami dan typhoon, ia tidak bermakna reaktor di negara ini tidak akan menghadapi kerosakan seperti di Jepun. Kemalangan buatan manusia boleh berlaku.

Pendek kata, selain daripada menyaksikan perkembangan reaktor-reaktor yang rosak di Jepun, Malaysia patut mengkaji projek dua reaktor tersebut dengan lebih menyeluruh dari pelbagai segi. Perkara ini memang mempunyai pro dan kontra. Adakah ia sesuai dan selamat untuk negara ini?

Taman Kepong to receive final titles for their homes soon

All 1,124 qualified titles of Taman Kepong can expect to be converted into geran or final titles by end-March, Residents’ Action Group (RAG) chairman M U Arumugam (pix) informed the packed crowd the good news at Pemadam’s office at Jalan Kuang Bulan today (13 March 2011).
The RAG’s meeting with the Federal Territory Land and Mines Office personnel on 10 March had been fruitful with the latter confirming that they will be sending a letter to notify Taman Kepong house owners of to collect their final title by end-March.
To date, 475 titles under phase one of Taman Kepong have been registered and are ready for collection while 49 titles are still held up.
In the case of phase two, 385 of the 600 titles have been registered with the rest to be completed by March.
Arumugam urged residents to immediately collect their titles once they are registered.
It was discovered that some transfers have not been properly executed with 150 titles issued in the developer’s name, Kepong Garden Development Sdn Bhd.
According to the Land Office, the developer still exists with the company’s registered address at Cangkat Raja Chulan, Kuala Lumpur.
For those house owners having their titles in the developer’s name, Arumugam said, “Let us know early and we will inform the Land Office to change the title to your name.”
“If you had received a photostat copy of the qualified title from the Land Office before, let us know and we will help you solve this problem.”
It was a case of this nature discovered by one of the residents three months ago that led the RAG to realise that the titles held by the house owners of Taman Kepong are only temporary.
“Because the Taman Kepong titles’ issue is 40 years old,” Arumugam said, “the transactions made were harder to trace as some residents did not keep their documents properly.
“Some have lost their sales and purchase agreements, and memorandum of transfer (MOT). To prove ownership of the land, evidence of this nature is important.”
He said these owners would not get their title deeds until the MOT is properly executed with the developer’s consent.
“The Land Office is willing to assist with the transfer but the owners will have to fork out the stamp duty.
“Without a proper transfer being carried out, the ownership of the property could be disputed and we do not wish this to happen.”
For titles carrying the old correspondence address, Arumugam said the letter from the Land Office might not reach the house owners. It is the owners’ onus to register a current correspondence address.

KEPONG – Lebih 40 tahun menanti, hasrat penduduk Taman Kepong, di sini bagi mendapatkan geran hak milik tetap semakin cerah selepas hampir empat bulan isu terbabit dibangkitkan baru-baru ini.

Sehingga kini, 475 geran di fasa satu taman sudah didaftarkan dan sedia untuk diambil, manakala 49 geran sama sedang diusahakan.

Bagi fasa dua perumahan berkenaan, 385 daripada 600 geran sudah siap didaftarkan dan dijangka dapat dilengkapkan pada Mac ini juga.

Pengerusi Badan Bertindak Penduduk Taman Kepong, M U Arumugam berkata, sehingga hujung Mac ini dijangka kebanyakan pemilik rumah sepatutnya menerima notis berkaitan daripada Pejabat Tanah dan Galian Wilayah Persekutuan untuk mengambil dokumen berkenan.

“Kita dimaklumkan kesemua 1,124 geran hak milik sementara dimiliki penduduk sebelum ini akan ditukarkan dengan geran hak milik tetap tidak lama lagi.

“Namun terdapat beberapa perkara masih menjadi kekangan kerana isu geran Taman Kepong ini sudah berlarutan lebih empat dekad lalu, transaksi lalu yang dibuat sukar disemak semula,” katanya ketika perjumpaan penduduk berhubung isu berkaitan dengan Ahli Parlimen Kepong, Dr Tan Seng Giaw, di sini.

Dalam pada itu menurutnya, terdapat sesetengah penduduk tidak menyimpan dokumen berkaitan dengan baik dan ada yang telah kehilangan Perjanjian Jual Beli Rumah (S&P) serta dokumen penukaran (Memorandum of Transfer) bagi membuktikan mereka pemilik tanah. Katanya, ini salah satu sebab badan bertindaknya menggesa penduduk untuk segera mengambil geran mereka sebaik selepas ia berjaya diproses.

“Kita dapati kebanyakan rumah dibangunkan oleh pemaju sama, penukaran hak milik tidak dilakukan sebaiknya.

“Pejabat Tanah mahu membantu penukaran tanah ini, tetapi pemilik perlu menjelaskan duti setem. Tanpa pindah milik mengikut prosedur sepatutnya, pemilikan hartanah ini sukar dilakukan dan kita tidak mahu ia berlaku,” katanya.

Sementara itu, Seng Giaw berkata, beliau juga berdepan masalah sama membabitkan penduduk di Kepong Baru dan Jinjang.

Beliau menyifatkan, isu berkaitan tanah sangat penting kepada penduduk dan sepatutnya diselesaikan sebaiknya seberapa segera.

“Lebih lama isu tanah ini tertangguh, ia akan menjadi lebih rumit. Bagi kes di Taman Kepong ini, mereka lebih bernasib baik kerana pemaju sudah membuat kerja ukur tanah bagi dua fasa ini," katanya kepada Sinar Harian.

Menurutnya, banyak projek perumahan seluruh negara berdepan isu hampir sama kerana terdapat ruang bagi membenarkan pemaju untuk lari daripada tanggungjawab.

Katanya, untuk itu beliau akan membawa isu ini ke Parlimen, bagi menggesa kerajaan bersama memikirkan mekanisme lebih efektif memantau pemaju bagi memastikan mereka memenuhi syarat pembangunan dalam jangka masa tetap ditentukan.

80% of home owners have secured original land titles

THE four-month struggle of Taman Kepong residents for land titles is nearly complete, however, the problem may be more widespread than imagined.

Status of their land titles first came to light when a case involving a 76-year-old woman who had received a photocopy of the document, instead of the original, from the Federal Territory Land and Mines Office in the early 1990s was discovered recently.

With the help of Kepong MP Dr Tan Seng Giaw, the Taman Kepong Action Group chairman M.U. Arumugam and his team has secured permanent land title grants for 80% of house owners.

“The problem was caused by the developer not conducting a proper survey. The calculation was in sq ft instead of per sq metre,” said Arumugam.

Department of Survey and Mapping Malaysia (JUPEM) handled the issue that the land office inherited from their predecessors.

Currently 475 titles in Phase One of Taman Kepong have been registered and are ready for collection, while 49 are still held up.

In Phase Two, 385 of 600 titles are already registered and the remaining to be completed soon.

When the issue of Taman Kepong came to light, neighbouring residential areas decided to check on their land titles and many of them realised they are facing the same problem.

Carl Loo and his girlfriend Annie Wong, both 25, turned up at the meeting organised by Arumugam and his committee to brief the residents about the status of the transfer recently.

According to Loo, Wong’s father realised that he had a photostat copy of the temporary title.

“We came on behalf of her father to check on the best way to proceed with this problem. We only found out about it after Taman Kepong residents highlighted the issue,” said Loo.

Arumugam said they found out about the other areas affected through a list sent by the land office of house owners whose land title had been issued.

Tan said the problem was prevalent throughout the country and nearby residents, including Kepong Baru,

Jinjang, Desa Jaya and Taman Ehsan are also affected.

“I will help the residents of Kepong Baru and Jinjang since they are in my jurisdiction. As for the other areas I will talk to the relevant MPs to brief them on the issue,” added Tan.

He also said they would solve the problem one step at a time to avoid chaos and panic.

However, there are several issues that need to be taken care of by the owners before the land title could be issued.

Cheers for Kepong Baru, Desa Jaya and Taman Ehsan residents

Since the issue of Qualified Title was raised by some residents of Kepong Baru, YB Dr Tan Seng Giaw as Member of Parliament of Kepong said he will also pursue the matter with the Federal Territory Land Office.

Dr Tan, who earlier met FT Land and Mines Office Head of Technical Department, Deputy Director, Yahaya B. Mohamad on March 10, urged the Land Office to look into the outstanding issues.

The longer this issue is dragged, the harder it is, for example, to place the obligation on the developer to pay to carry out land survey.

Meanwhile, residents of Taman Ehsan and Kepong Baru who contacted us have also been advised to meet with their State Assemblyman, YB Elizabeth Wong and Member of Parliament, R. Sivarasa.

In an email response, Elizabeth Wong said that she has already spoken to the Director of Gombak Land Office. A briefing will soon be carried out within the month of March by the Director himself, she said.

Arumugam revealed the figures after another successful meeting with the Land Office officials on Wednesday (March 10). “We were told all 1,124 Qualified Titles should be converted into final title soon,” he said.

According to a resident, Stephen Ng (黄荣裕), his mother was one of the residents who were given photostat copies of the title back in 1994. Ng said, although no allegations are made against any party, in order to protect his mother’s interest, a police report has been lodged and a Statutory Declaration made in accordance to the Land Office procedure for titles considered lost.

“The comforting thing for my mother is that after 17 years, when we discovered it was a Photostat copy of the Qualified Title she had with her in the safe deposit box, the Land Search revealed that there was no transaction made,” he said.

Ng urged all housebuyers to check their documents to make sure that they are in place. “As a title deed is a legal document which is used to prove ownership of a piece of property, especially for homes and vehicles, we cannot afford to be negligent,” he said.

There are also titles that still carry the old correspondence addresses. “For this reason,” Arumugam said, “the letter from the Land Office do not eventually reach the house owners. It is the onus of the owners to register a current correspondence address.”

Kepong MP Dr Tan Seng Giaw said he will also be looking into a similar issue involving residents of Kepong Baru and Jinjang. “Land matters are important to the people, and should be dealt with urgently,” he said. “The longer it is delayed, the more complicated it becomes.”

Dr Tan said that, in the case of Taman Kepong, residents are fortunate because the developer had already conducted the survey of the two phases. “However, in Kepong Baru, the survey was never carried out, and now, we have the question of who should pay the bill,” he said.

Dr Tan said a number of other housing estates throughout the country are facing similar issues and there are loopholes which allow developers to abscond from its responsibility. “I will raise this matter in the parliament soon, to urge the Government to put together a more effective mechanism to monitor the developers to ensure that they are fulfilling their obligations, following a strict timeline,” he said.

LAND TITLE CHEER FOR TAMAN KEPONG RESIDENTS

A MEETING WAS HELD AT LAND OFFICE ON MARCH 13, 2011 (THURSDAY) to check on the current status. The Resident Action Group Committee, led by YB Dr Tan Seng Giaw, met up with the Head of Technical Department of FT Land & Mines Office, En Yahya.

According to En Yahya, by end of this month, all residents should be able to get their final title.

However, there are still some issues that need to be thrashed out. The Action Committee will be calling for a meeting at Pemadam Office on Sunday 13 March 2011 to work out the outstanding issues.

  • There are currently 49 files in Phase One being held up in JUPEM, which will be passed on to the Land Office for registration of final title.
  • There are also titles that are issued in the name of the developer, which means, ownership of the plots of land would remain in the name of the developer until a transfer is properly executed. According to the Land Office, Kepong Garden Development Sdn Bhd still exists as a company with a registered address in Cangkat Raja Chulan, Kuala Lumpur.
  • There are also some residents who were given photostat copies of the title back in 1994, and others who lost their original titles. They have to lodge a police report and make a Statutory Declaration and submit their application to the Land Office for a new title to be issued.
  • There are also titles that still carry some old addresses held by the Land Office. Letters sent by the Land Office do not therefore reach the house owners, because the letters are sent to the registered addresses.

Let us solve this issue as soon as possible. The longer this issue is dragged, the harder it is to trace the old records. From the Land Office's point of view, we believe they will find their records in order, instead of facing questions of what to do when the developer failed to carry out survey of the area and had gone bankrupt, as in the case of Kepong Baru.

Last Wednesday (16 Feb 2011), YB Dr Tan Seng Giaw, Member of Parliament, Kepong and some residents went to the Survey and Mapping Department (JUPEM) where they were told:

(a) There are two sets of files - one registered in 1962 and a second set in 1969.
(b) JUPEM has already and completed the survey and mapping of Taman Kepong some time ago. Except for 50 files, they have handed over the rest of the files to the Land Office.
(c) According to the Land Office, some 400 house owners should be getting their titles soon.

On February 23, 2011, Dr Tan brought a group of residents to the FT Land Office (see picture).

(1) It is learnt that Encik Latif Ali has been transferred to Putrajaya with immediate effect.

(2) It is learnt that some 400 files (which probably came under Phase One with 524 houses mentioned by En Latif earlier on) have already been processed, mainly from the first set of files registered in 1962 (probably Phase Two with another 600 houses).

Two of the committee members who had their HSD and PT Numbers were able to verify that the final titles have been issued by the Land Office and ready for collection.

Another committee member whose house is in Jalan Tengah found out that his final title has not been issued yet. It is believed that this is the second set of files registered in 1969 are still with the Technical Department in the Land Office.

To check with the Land Office the status, please contact and provide the HSD Number and PT No via email to ejng@pc.jaring.my. Upon compilation of a list, an email will be sent to the Land Office to check the status. Correspondence via email will not disrupt the daily routine of Land Office staff.

If your titles have been issued, please arrange to collect the titles at the counter on Ground Floor at Federal House (Rumah Wilayah Persekutuan). Bring along:

(a) Original copy of your Hakmilik Sementara
(b) Original copy of your latest Cukai Tanah (Quit Rent) which shows you have made the payment.

ADDITIONAL ADVICE: IF your house has more than one owner, you need to produce a letter of authorisation which is signed by every joint-owner and bring along a copy of the individual IC (written on it "Untuk Kutipan Geran di Pejabat Tanah Sahaja"). One representative is sufficient to collect the final title.

(3) We were shocked to learn that some of the final titles are still registered under the name of the developer, Kepong Garden Development Sdn Bhd, with a registered address at No 27 Main Street, Kepong. We have urged the Land Office not to send the notices to this address, but deal with them separately.

(4) We also found that some of the owners still had their old correspondence address with the Land Office. For example, Mr Arumugam's registered correspondence address is still with his old house in Taman Nanyang. This means, the notice to collect the final title (or Geran) will be sent to the old address. WE THEREFORE ADVISE RESIDENTS TO CHECK THE STATUS OF THEIR FINAL TITLE WITH THE LAND OFFICE, IF THEY HAVE NOT RECEIVED THE NOTICE TO COLLECT THE FINAL TITLES.

RESIDENTS of Taman Kepong in Kuala Lumpur are urged to check their temporary land titles to see if they were given photocopies.

Taman Kepong Action Group chairman M.U. Arumugam asked residents to check following a case involving a 76-year-old woman who had received a photocopy of the document, instead of the original, from the Federal Territory Land and Mines Office in the early 1990s.

“We have one case now, but we suspect there are more. We ask those who have been given a photocopy of the document, to come forward and make a police report, so we can take the next course of action to rectify this matter.

“It would be impossible to transfer the title from temporary to a permanent land title grant without an original copy,” he said.

Earlier, about 1,000 home owners in Taman Kepong were left in limbo after discovering that they had only temporary land titles to their homes.

With assistance from the action group, Kepong MP Dr Tan Seng Giaw and the Federal Territory Land Office, 80% of home owners secured permanent land titles to their homes in the 40-year-old neighbourhood.

Arumugam told affected residents they could meet up with the Action Group this Sunday at 3pm at the Pemadam office in Jalan Kuang Bulan, Kepong for assistance in the matter.

KUALA LUMPUR: Three months ago, more than 1,000 homeowners in Taman Kepong were left in a limbo after discovering that they had only temporary land titles to their homes.

Thanks to the effort of the Taman Kepong Action Group, Kepong MP Dr Tan Seng Giaw and the Federal Territory Land Office, 80 per cent of homeowners can now heave a sigh of relief as they now have the permanent land titles to their homes in the 40-year-old neighbourhood.

The group's chairman, M.U. Arumugam, announced this at a press conference recently, adding that some of the 500 homeowners had collected their titles upon receiving letters from the land office.


However, Arumugam said another problem concerning the temporary land title document has cropped up -- some of them are photocopies .

The group has called on those affected to ensure that their temporary land titles are original.

The issue was brought to light after a resident, Stephen Ng, said he recently discovered that his family's temporary land title kept by his mother was in fact a photocopied document.


"This could pose another hurdle to residents in obtaining the permanent land titles of their homes as they won't be able to get it so soon.

"The land office has got to conduct checks to determine that an individual is a bona-fide owner of a house.

"We do not know how many homeowners have the photocopied temporary titles.


"We're requesting them to come forward," said Arumugam.

He said they are expected to meet with the land office to further discuss ways to resolve the problem today.

He said that the group will come together again on Sunday.

He urged those with the photocopied temporary land titles to meet at the Pemadam office at Jalan Kuang Bulan in Taman Kepong.

The meeting will take place at 3pm.

The next course of action would be for them to lodge police reports.

Subsequently, they have to take an oath before the Commissioner of Oaths.

Tan, who has been helping the residents to pursue the matter, also advised homeowners with the photocopied temporary land titles to put caveats on their properties.

Tan said the land where Taman Kepong sits on is freehold.

"Legally, homeowners should have permanent land titles to their homes," he said.

Ng was told by his mother that the document furnished to her by the land office was said to be the only one when she collected it back in 1993 or 1994.

Following that, Ng's mother lodged a police report at the Kepong station on Friday.

"I hope those who are in the same situation as my mother will come forward so that the group can help them to get the permanent titles issued to them.

"This matter is serious as the original title could have fallen into wrong hands and subjected to misuse," said Ng.
