Comments

The longer the issue of land title in Taman Kepong is dragged, the more impatient people will become, especially since the Minister of Federal Territories and Urban Wellbeing, Datuk Raja Nong Chik, had promised that this would be solved very soon.

The Land & Mines Office, which promised one-month deadline from the time the files from the Survey and Mapping Department (JUPEM) reach them, is also not keeping to its deadline.

The patience of the people can only be tested to a certain limit, as this affects their hard earned property deed of title.

This is clearly seen from the number of people who turned up to meet their local Member of Parliament, YB Dr Tan Seng Giaw. As time went by, more people turned up for the meeting with the MP, wanting to know the status of the title.

This, according to one resident, is an opportunity for them to meet their Member of Parliament in person. Some residents also took the opportunity to discuss other issues with Dr. Tan, urging him to highlight their complaints to the local authorities.

Others affected, too

Residents turned up from other housing estates as well, when they also discovered that they have a similar issue faced by residents of Taman Kepong. One resident from Kepong Baru said that she was also shocked to find out that her title carried the same status. "I cannot believe it is 'Hakmilik Sementara,'" she said. "How can the Prime Minister continue to talk about putting the People First, when our issues are being overlooked by the FT Land and Mines Office? This is a bane to the slogans that we hear so much about."

Another resident from Jinjang said she will encourage other people in her neighbourhood who are having the same issue. "We thank Dr. Tan for bringing this to the attention of the authorities," she said.

Some of these residents also have children who are living in other townships. One of them, whose mother is still living in Taman Kepong, said he decided to switch his voting station to Paya Jeras, where the constituency is held by Umno. "Because of this sore point, I am going to help the Pakatan people to campaign during the next General Election, just to deny the Barisan Government another term in Putrajaya," he vowed.

Voice represented, but will they hear?

Residents were generally pleased to hear it when Dr. Tan announced to the audience that he would raise their issue in the next parliamentary session when it meets in March. "This is in fact a national issue," he said. "I will raise your issue in parliament when we meet in March."

The longer the FT Land and Mines Office and the Survey and Mapping Department dragged this issue, the more angry people will become. The fact that 21 house owners have so far received the notice to change the qualified title to final title would not pacify some 200 residents who turned up at the Pemadam Office in Taman Kepong on Jan 23.

The question is whether the BN Government, which is currently under Najib Razak, will listen to the Member of Parliament of Kepong or will it continue to remain arrogant, indifferent and living in denial. Even the Malay Mail reporter who wanted me to say that I was pleased with the response received from the Minister of Federal Territories, I stopped short of saying it. "We will see," I told her. "We will see how long this issue will be dragged." I told her that the people will continue to hold the Minister and his ministry accountable until every single title is converted to final title.

One Housing Estate

Some Phase Two of Taman Kepong residents, who turned up at the meeting, were particularly not happy with the progress in their phase. One of them said that he will rally the people in his neighbourhood together in the next meeting. "We felt left out, when Phase One residents started meeting without informing us," he said.

However, Protem chairman of the Taman Kepong Action Group, M. U. Arumugam said that Phase One or Phase Two, the action committee would continue to pursue the issue until every single house owner is issued the final title. "However, we hope our Phase Two brothers and sisters will join us in our next course of action, which we plan to do after the Chinese New Year," he said. "As a matter of fact, we did not even know that Taman Kepong has two phases until the Land Office told us so."

For that reason, Arumugam argued: "Subsequently, we wrote to the Land Office with the help of the Member of Parliament to ask for further clarifications on Phase One and Phase Two. However, since the Land Office chose not to respond to the question, we take it that there is only one Taman Kepong, and with this, the Action Group will continue to campaign for the title with the help of our Member of Parliament --- until each and every house owner gets his or her final title! No one will be left out."

Arumugam said that residents of Phase Two who are concerned about the status of their Qualified Title can contact him at 016-2894355 and they should also organise themselves so that there is one representative for every road.

Bridge construction starts next year

Monday, December 27th, 2010 15:42:00

KUALA LUMPUR: Kepong MP Dr Tan Seng Giaw has urged City Hall to speed up a bridge project linking Taman Emas to Taman Metro Prime in Kepong here.

"RM1 million has been allocated to rebuild the bridge which collapsed five months ago due to heavy rains, so there should not be a delay," he said, adding that the matter came to light during a meeting he attended early this month between KL mayor Datuk Seri Ahmad Fuad Ismail and a representative of the Public Works Department.

Tan said the original bridge was not built by the government but had been serving thousands of residents and visitors to the area for the past decade.

When contacted, Ahmad Fuad said work on the bridge was scheduled to start early next year.

Dual title status confuses Taman Kepong residents

By FAZLEENA AZIZ

RESIDENTS of Taman Kepong in Kuala Lumpur are confused over the title of their homes as the grants state the status as temporary as well as freehold.

The problem cropped up recently after some residents settled their bank loans and went to collect their grants.

In the 11AK Form it is stated temporary ownership and also freehold at the bottom of the page.

Other residents realised the problem when they wanted to sell their property.

Taman Kepong, consisting of 534 houses in Phase 1 and 600 under Phase 2, are supposed to have freehold titles. The houses were built by Kepong Garden Development Sdn Bhd in the 1970s.

A meeting was held with about 200 affected residents to gather information as well as bring them together to resolve the problem.

Taman Kepong action group chairman M.U. Arumugam said they planned to get more information from the land office and survey department.

He said they were unable to trace the developer as the development was 40 years old.

“The land office said a proper survey on the properties was not carried out, hence the problem with the titles.

“We are happy the residents are united in resolving the matter and they have been cooperative,” he said.

Kepong MP Dr Tan Seng Giaw, who was present at the meeting, said 47 houses had now been surveyed under phase 1.

“The main fault lies with the developer as it is their responsibility, but Kuala Lumpur City Hall, Housing and Local Government Ministry and survey department should have better supervision.

“Most residents are unhappy with the situation so we want to survey the area after the Chinese New Year,” he said.

Dr Tan said in the past, it was not compulsory for surveyors to get a licence or for owners to apply for a permanent land title.

Registered land ownership for a development would normally involve the issuance of qualified ownership to its owners.

The final title will be issued after a licensed land surveyor appointed by the project developer has carried out a survey and submitted the plan to the Survey and Mapping Department for validation.

The Survey and Mapping Department will then check, verify and produce a certified plan to be registered by the Land Office.

NOTE:
To avoid any further confusion, corrections to the article are highlighted here the sake of residents:

1) RESIDENTS of Taman Kepong in Kuala Lumpur are confused over the title of their homes as the grants state the status as temporary as well as freehold.

The Committee and YB Dr Tan has on numerous occasions explained that (a) the titles are freehold if it is stated in their title deeds as "Kekal". (b) The confusion is because the title also used the name "Hakmilik Sementara" (Qualified Title). (c) The main issue that residents want to address is not whether it is freehold or leasehold. It is the question why the title is still "Qualified Title" (Hakmilik Sementara) instead of Final Title (Hakmilik Akhir). Hope this explanation will give residents a clearer picture of the issue.

2) Taman Kepong, consisting of 534 houses in Phase 1 and 600 under Phase 2, are supposed to have freehold titles. The houses were built by Kepong Garden Development Sdn Bhd in the 1970s

We were told by the Land Office that there are 524 (correction, 524) houses in Phase One and 600 houses in Phase Two.

3) “The land office said a proper survey on the properties was not carried out, hence the problem with the titles.

We wish to inform that this statement has been misquoted. The Land Office has informed us that (a) survey and mapping of Phase One has been done previously, but need to be converted from the Imperial System to the Metric System (i.e. from "kaki persegi" to "meter persegi"). This means that Phase One residents should be getting their titles changed to Final Title soon, depending on how soon the Survey and Mapping Department makes the conversion of land area; and from the time that the Land Office receives the file, they need about one month to issue the final title. TO DATE, 21 houses have been informed of the change of status of their title. They have to present their "Hakmilik Sementara" to the Land Office and collect their Final Title immediately.

(b) The other 600 houses in Phase Two are not so fortunate as the developer had failed to carry out the survey. Efforts have to be made with the help of Dr Tan Seng Giaw to urge Survey and Mapping Department (JUPEM) to carry out the necessary survey, before the files can be presented to the Land Office for the issuance of Final Title. This is why the Taman Kepong Action Group has urged representatives from Phase Two to meet Mr M.U. Arumugam.

4) Kepong MP Dr Tan Seng Giaw, who was present at the meeting, said 47 houses had now been surveyed under phase 1.

Dr Tan has been misquoted here. He was the leader of the delegation who went to the Land Office to talk to the Deputy Director, Latif Ali. In the discussion, Encik Latif said that 47 house owners would be the first batch to receive their final titles. The list was later provided to Dr Tan and copied to the Action Group Chairman, M.U. Arumugam, who counted the number of houses under TAMAN KEPONG as 21. The rest of the houses are in other housing estates, which has led us to believe that more housing estates are having the same problem with Qualified Title ("Hakmilik SEMENTARA." Go back to some of the blog posts here to see the list and inform your friends to contact Dr Tan, who will be raising this matter in parliament in March this year.

We have said that Phase One (524 houses) have been surveyed previously, and technically, the residents will be able to receive their final titles soon. If they still fail to receive their final title, this speaks volume about the efficiency of the Land Office and the people who managed the office before this. I am sure the good office of En Latif Ali would put things in order.

One reason why certain houses were picked to be given the final titles first (instead of being done in proper order according to the roads), in my opinion, is a reflection of how the previous staff of both JUPEM and/or Land Office had kept the files. It is hoped that there will be springcleaning now that they are working hard to put things in order. I don't think I want to comment any further what has been done in the past, but what we can do from here.

Press statement by Dr Tan Seng Giaw 24 January 2011

DAP National Deputy Chairman and MP for Kepong Dr Tan Seng Giaw urges the Natural Resources and Environment Ministry to raise its efficiency and improve its services, such as simplifying the procedure for land titles. This will help solve the problem of land titles involving 1124 houses in Kepong Garden.

In 2011, the allocation for Land Management and laws Department in the ministry is RM176 million. This money should be used effectively to improve the service in land offices in the country.

Ob 23.1.2011, Dr Tan met residents in Kepong Garden to explain the steps taken towards solving the land title problem.

For over 40 years, Kepong Garden residents have no final land titles. But, their land is freehold. Previously, it was not compulsory for a surveyor to get a licence. Neither was it compulsory for house owners to apply for final titles. Then, the developer, who is ultimately responsible for land titles, Survey and Mapping Department, City Hall and Housing and Local Government Ministry must play their parts.

There are two phases in Kepong Garden. Phase 1 consists of 524 units and Phase 2 600 units. The Survey Department must complete accurate survey before final titles can be issued by the Land Office. Hitherto, 47 units have their lots surveyed. Work is going on with the rest of the 524 units. We are going to the Survey and Mapping Department to ascertain when work will be done on the 600 units in Phase 2.

Besides Land Office and Survey and Mapping Department, City Hall, Housing and Local Government Ministry must review the problems of housing and land titles, cutting down bureaucracy and red-tape. Those who visit these departments such as land ofice, meet good and bad personnel. If they are lucky, they meet good ones. Otherwise, they are frustrated, being kicked form one end to the other.

A successful meeting with YB Dr Tan Seng Giaw

A successful meeting with YB Dr Tan Seng Giaw

Over a hundred residents of Taman Kepong came together to meet the Member of Parliament of Kepong, Dr Tan Seng Giaw.

Dr Tan, accompanied by his wife, explained to the audience the process in which the title is issued, and why residents are currently stranded with the Qualified Title (Hakmilik Sementara).

"The reason is because the Survey and Mapping Department will have to approve the land survey, which the developer was supposed to have carried out," he said.
It was learnt that the survey for Phase One with 524 houses has been carried out, and the files are still with the Survey & Mapping Department, awaiting conversion from square feet to square metres.

However, the developer failed to carry out the survey and mapping of Phase Two in Taman Kepong. "The Action Group urge the residents of Phase Two to come forward and be represented so that a delegation can make a trip to JUPEM to urge them to sort out the issue as soon as possible.

Some residents from Jinjang and Kepong Baru also turned up. Apparently, they also encountered the same problem with Qualified Title (Hakmilik Sementara).

Dr Tan said in the March parliamentary session, he will bring this up as a national issue and urge the authorities to solve the problem with great urgency. In the Klang Valley, we learnt that a number of other housing estates and constituencies are also affected - namely Sri Delima, Batu Caves, Jinjang, Jalan Besar Kepong, Kepong Baru, Sentul, Taman Wahyu.

As a result of efforts undertaken by the Taman Kepong Action Group, the first batch of 21 house owners in Taman Kepong have already received their letters from the Land Office to change their "Qualified Title" (Hakmilik Sementara) to Final Title (Hakmilik Tetap).

Residents were, however, disappointed with the Kepong Police. Its chief failed to turn up, instead, sent Sarjan Mejar Zakaria, who sat through part of the meeting and left before his turn to address the Taman Kepong residents' concern about security in the area. Residents have expressed their concern that crime rate has gone up in the past three years, with a number of houses being broken into, mainly by foreigners.

Good to know we are not alone

Whether it is in Taman Kepong or in Taman Bukit Angkasa, the people have been suffering in silence after 54 years since Independence.

While in Taman Kepong, we found out that our title is "Hakmilik Sementara" (until now, there is still no further progress after the 21 houses announced last week), in Taman Bukit Angkasa in Lembah Pantai, they have other major issues that have not been resolved.

According to the residents there, they are also very pissed off with the lack of response to their complaints. Here is a blog which a friend sent to me:
http://blok14tamanbukitangkasa.blogspot.com/

So, Taman Kepong residents are not alone. Ask yourself why people are now turning to the Members of Parliament for help, unlike in the past where they have been suffering quietly!

WE MEET THE CONDITIONS

“However, Federal Territories and Urban Wellbeing Minister Datuk Raja Nong Chik Raja Zainal Abidin said a residents' association had to be set up before the application could be processed.” (NST dated 12 January 2011).

A Resident Association has already been set up on 21 December 2010 under the registration number of 2909-10-WKL by the Action Committee of Block 14. After which, the application for 1Malaysia Maintenance Fund was submitted on 7th January 2011. It is currently in Putrajaya and according to the officer in charge, who has acknowledged receipt of the application mentioned that the technical team will be in touch with us. He also mentioned that depending on the urgency of the matter, it can take one to months.
The Action Committee has been campaigning for the pipe system to be resolved since September 2010 knocking at the doors of the developer, DBKL, Syabas and also with the Deputy Minister from the Prime Minister’s Department T Murugiah who has failed to uphold his words, all have fallen on deaf ears.
We have written to Dato’ Raja Nong Chik on 12 January 2011 to explain to him about how we have met all the conditions required by the 1Malaysia Maintenance Fund.
We have also written to Syabas on 12 January 2011 to request that they waive the residents’ high bills other than the minimum payment. The Residents’ Association is asking for this problem to be settled within one month. Please stop this suffering immediately!!!!
The Action Committee on 16 January 2011 called for a press conference. Several reporters attended the press conference. The Action Committee wanted them to highlight that the Residents’ Association of Block 14 Taman Bukit Angkasa qualify to receive the funds from the 1Malaysia Maintenance Fund because they meet all the stipulated conditions. This is also to put on record what has transpired to date.
When the MP of Lembah Pantai, YB Nurul Anwar came to lend her support, the Action Committee officially requested her office to raise a number of issues which residents of high rise buildings are facing every day in Parliament and urge the authorities to look at the policy matters urgently, because issues of this nature affect the people’s livelihood. A lot of time is wasted on unproductive work of having to attend to these issues. They include all the other generic issues such collapsing roof tops and repair of the common area fuse box.
The Residents’ Association records their heartfelt thanks to YB Nurul for her constant care and concern for the constituency even though she does not have the public funding under her control. She is always ever ready to step forward as long as she is needed irrespective of sunshine or rain, and we will continue to invite her to come down to the ground as often as possible to be with the people until the issues are solved. We want to have an MP who will be with the people, not one who comes down occasionally and choose who he will help, and who he will not help. Thank you, YB Nurul Izzah Anwar! We hope that you will come to Bukit Angkasa more often! We welcome you with open arms, until all our issues are solved!

YB NURUL'S VISIT TO BLOCK 14 - A CARING MP

YB Nurul made a visit to meet our residents, many of whom met her and gave very positive assessments of her visit. One resident remarked that although YB Nurul as an MP does not have any hold of government funds (i.e. our money), she showed that she cared enough to meet the people. (It was raining so heavily that day but she still came). We will be scheduling more visits by YB Nurul in the near future on this issue and a number of other problems faced by the residents. YB Nurul’s office staff have been in close contact with the Action Committee to keep a tab of its progress. We truly appreciate YB Nurul’s caring attitude, compared to a number of other government agencies, whose doors we have been knocking for some time.

NO SOLUTION YET TO THE BIGGEST BURDEN OF THE PEOPLE - PIPE SYSTEM

The Action Committee of Block 14 took it upon them to highlight the biggest burden that the pipe system was causing the people for about 10 years now. Most of the residents are of lower income group and have spent about RM7,000 including the hefty water bills that they have to pay to Syabas. The cost of repair and water bills is till rolling in. Therefore, after calling the developer, DBKL and Syabas who say that it has got nothing to do with them, the Action Committee decided to take the problem to Biro Pengaduan Awam. A dialogue session with YB Senator Dato' T. Murugiah was fixed.
DIALOGUE SESSION WITH YB SENATOR DATO’ T. MURUGIAH, BIRO PENGADUAN AWAM
Dato’ T. Murugiah was invited to have a dialogue session with the residents of Block 14 as a way to solve the following problems:
1) Pipe System
2) Illegal stalls and extensions by shop owners encouraging breeding of mosquitoes, rats, cockroaches, etc. (while we are sleeping, these are keeping watch and having a great meal)
3) Collapsing roof tops along the corridor
YB Dato’ came on 11th November 2010 and took a walkabout with the respective agencies and residents. He was shocked to see the current pipe system and remarked that this was the first time he has ever seen something like this. He then proceeded to address the problems with the residents in about 30 minutes. He directed the agencies to take the necessary steps to solve the concerning issues of the residents. He promised to return after two weeks. However after numerous reminders and calls, YB Dato’ is yet to honour his word. Also, no calls have come from his office to advise the people of how to overcome their problems.
The meeting was not favourable to the residents. Syabas was then asked to provide the Action Committee with a quotation. The estimated quote was RM55,000. The action committee later met up with a representative on behalf of YB Raja Nong Chik’s office in December. The action committee forwarded a letter to YB asking him to look into the problem. A site visit followed. The Action Committee was then asked to seek funding from the Tabung TP 1Malaysia. The forms were submitted with the respective photographs and now waiting to hear from them. The Action Committee also strongly recommended their own plumbing contractor who gave a quote of RM45,000.00.

The article in the newspaper (Nanban, 12th November 2010), highlights his visit and that he will look into our problems as soon as possible. Now it is going to be 2 months and still no news from him. Neither has he revisited us as he said he would do. Not one of the issues that we highlighted to him has been dealt with. Because of this, the committee finally decided to approach YB Nurul Izzah Anwar, the MP of Lembah Pantai on 9th December 2010.

As of today, the pipe issue problems are still pending (and all other issues as well). Frustrated and disappointed with the slow response received from the day we started campaigning, the residents approached YB Nurul once again to ask her help to raise the complaints on behalf of the residents.
Until this issue and others are solved, we will continue to meet YB Nurul, because we see that she cares for the welfare of the people, despite not having the means to help.

INTRODUCTION TO BLOCK 14, TAMAN BUKIT ANGKASA, KUALA LUMPUR

Block 14 of Taman Bukit Angkasa, Kuala Lumpur is situated in Lembah Pantai. The block consists of 80 units. 90% of the residents are Indians with 10% of them comprising of Malays and Indonesians. The block is surrounded by 18 other blocks where the majority of its population are Malays. Block 14 recently was facing a lot of problems in terms of rubbish, mosquito breeding, huge rats, stray cats, drain clogging and not mentioning the most odd pipe system as quoted by Dato' T Murugiah of Biro Pengaduan Awam when he came to visit the residence in November 2010 as one that is so unique that he has not seen them in any part of this world. The photos below just shows what he meant.

All these happened 10 years ago when the residents found that their water bills have sky-rocketed to RM2000 or more. When contacted the developer and management office, Nakkon (M) Sdn Bhd as well as Syabas, the residents were informed that there was a leakage in the underground pipes. Also, rusted water was flowing through our taps. The residents were then asked by both the developer and Syabas, to hire their own contractors to do the repair works. As a result, a very special piping system emerged.

A few residents got together last October to form a Residents' Association. While waiting for the approval from the Registrar of Societies, this small group of 12 members with 4 members in the Action Committee took some healthy steps as follows:

1) Gotong-royong activities
2) Recycling campaign
3) Collection of maintainance fees
3) Dialogue session with Dato' T Murugiah from Biro Pengaduan Awam, DBKL and Syabas
4) Visit by the Member of Parliament, YB Nurul Izzah
5) Site visit by Officer from the Pejabat Menteri, Kementerian Wilayah Persekutuan dan Kesejahteraan Bandar
5) "You are my neighbour" programme

This small group of committee members are working very hard to make Block 14 into a healthy and safe living environment.
